Terms & Conditions

This is a sample form that will be provided to you upon starting your Jiu Jitsu Program. 

I, ______________ , am hereby enrolling in a gym membership, participating in a seminar, personal training and/or exercise program of strenuous physical activity including, but not limited to, jiu jitsu, wrestling, judo, boxing, kick boxing, speed training, weight lifting, plyometrics (the “Programs”) and the use of various aerobic conditioning and strength training machinery and equipment (the “Equipment”). I understand that services may be offered by independent personal trainers (the “Trainer”) at Forge Myoconditioning Victoria Inc. (“Forge”), Suits U gym facility, or any official satellite locations.

I acknowledge and agree that I have been advised to consult with my physician and obtain his or her consent (“Physician Consent”) prior to starting the Programs at Forge or increasing the intensity of existing Programs at Forge, indicated both in this release and by Kaiser Jiu Jitsu. I hereby assume full responsibility for obtaining the Physician Consent, as indicated by my signature to this release and, if I choose to, will undertake to act on this advice prior to the implementation of any recommendations made by the Trainer with whom I enter into the Programs, or Forge. I hereby affirm that, to the best of my knowledge, I do not suffer from any condition that would prevent or limit my participation in the Programs and have not withheld any related information from the Trainer with whom I have agreed to obtain services from Kaiser Jiu Jitsu.

In the event that, upon consultation with my physician, I am assessed to be other than apparently healthy, I have been given a physician’s release, as required by Kaiser Jiu Jitsu, to engage in the Programs at Kaiser Jiu Jitsu. I agree that I am taking no medications that could adversely affect my fitness activities. In addition, I acknowledge that if the status of my health changes, it is my responsibility to recognize the change and seek medical advice to help me ascertain if my continued participation in the Programs, or any derivative part thereof, is still right for me.

I fully understand that I may injure myself as a result of my participation in the Programs at Forge/ Kaiser Jiu Jitsu, which may be the result of my own actions or the actions or omissions of others or both, and I acknowledge and freely accept and fully assume all such risks, dangers and hazards and the possibility of any personal injury to me or death, which may include, but is not limited to, heart attack, muscle strain, joint injuries, or death, however caused, occurring during, or after, my participation in the Programs at Forge, unless caused by the intentional misconduct of a Trainer, in which case I indemnify Kaiser Jiu Jitsu,  Forge, its directors, officers, agents and representatives, from any and all claims, actions, costs, expenses, and demands, now or in the future, for any injury, death, loss or damage that I or my next of kin may suffer arising out of the recklessness or intentional misconduct of the Trainer.

I hereby release, save harmless and indemnify Kaiser Jiu Jitsu, Forge, its directors, officers, agents and representatives, from any and all claims, actions, costs, expenses, and demands, now or in the future, for any injury, death, loss or damage that I or my next of kin may suffer arising from my participation in the Programs, including my use or misuse of the Equipment, defects in the Equipment, and the negligence of Forge and any one or more of its directors, officers, agents or representatives.

I acknowledge that this release is an important legal document relating to my involvement in Kaiser Jiu Jitsu at Forge. I understand and agree that this release and waiver of liability will be effective and binding upon my heirs, next of kin, executors, personal representatives, administrators and assigns.

I hereby affirm that I have read and fully understand the above information. I have been given an opportunity to present any questions in all related matters to Forge prior to executing this agreement.

By signing this Release and Waiver of Liability, I represent that I have read and agree to the terms and conditions contained herein and I am waiving certain legal rights which I may have against the released parties, including the right to sue under this Agreement.
